Compliance checklist 2026: Poland, Netherlands, Belgium logistics
21/3/2026 · 1387 views
Carriers operating cross-border routes between Poland, the Netherlands and Belgium in 2026 must prioritize electronic freight transport information interoperability, synchronized digital tachograph data, and strict adherence to each country’s cabotage and customs notification regimes to avoid downtime at borders and costly fines.
Key regulatory and operational checkpoints for 2026
Logistics providers should treat the following items as mandatory components of their compliance program when planning shipments across Poland, the Netherlands and Belgium:
- Digital data exchange: Implement eFTI- and eCMR-capable systems to enable verified digital consignment notes and on-demand access to transport documentation.
- Tachograph and working time: Ensure all drivers use smart tachographs and that digital records are retained according to EU and national retention rules.
- Customs pre-clearance: Prepare ENS/ICS notifications for inbound shipments and validate EORI registrations for shippers and forwarders.
- VAT and e-commerce: Use IOSS or appropriate VAT procedures for EU distance sales and be prepared for audits on declared values and tax treatment.
- Dangerous goods and vehicle safety: Maintain ADR compliance, current inspections, and driver certifications for hazardous cargo.
Cross-border differences: Poland vs Netherlands vs Belgium
Although all three countries implement EU regulations, national administrative practices and enforcement intensity differ. The table below summarizes practical distinctions logistics managers should track.
| Requirement | Poland | Netherlands | Belgium |
|---|---|---|---|
| eFTI / digital documents | Rapid adoption among carriers; IT integration with national inspection authorities is essential. | High digital readiness, strong enforcement of electronic records during roadside checks. | Active audits of digital manifests; major ports require consistent e-documentation. |
| Customs pre-declaration | Strict checks on transit documents for goods arriving from non-EU origins. | Port-centric controls, especially at Rotterdam/Amsterdam approaches. | Focus on accurate ENS filing and antidumping/targeted inspections. |
| Cabotage & permits | National controls include recording of cabotage operations; permits may be requested. | Frequent roadside verification; operators should document consecutive journeys. | Close monitoring of cabotage days and driver papers. |
| Emission & environmental rules | Local low-emission zones in major cities require pre-clearance. | Congestion pricing and local environmental surcharges apply in urban zones. | LEZ measures and stickers required in selected municipalities. |
Detailed checklist for carriers and forwarders
Operational readiness should be validated across people, processes and technology. A practical checklist includes:
- Systems: eFTI, eCMR, digital tachograph download and backup, EDI/AS2 connections to major shippers and terminals.
- Documentation: EORI, commercial invoices, packing lists, IOSS registration (for e-commerce sellers), and ADR certificates when applicable.
- Contracts: Clear Incoterms, liability clauses for digital documents, and agreed processes for reclamation and audit trails.
- Training: Driver briefings on national rules, cabotage limits, and digital device use; staff training for customs declarations and VAT handling.
- Insurance: Cargo insurance that covers cross-border transit, digital claims handling and declared value verification.
Documentation and digital systems — practical setup
Ensure the following elements are in place before scheduling cross-border loads:
- EORI numbers for trading entities and freight forwarders.
- Customs pre-declaration systems configured for ENS/ICS submissions and responses.
- Digital consignment note templates compliant with eCMR and accepted by receiving terminals.
- Secure data retention for tachograph and cargo documents in line with GDPR and national retention rules.
Operational measures to reduce inspection delays
Practical steps that reduce border dwell time and inspection incidence:
- Pre-validate container seals and record seal numbers in the shipment manifest.
- Use port links and slot booking to minimize queuing at Rotterdam, Antwerp and Gdańsk terminals.
- Adopt standardized packing and labeling formats to speed up customs checks.
- Maintain a digital audit trail accessible to customs authorities upon request.
Checklist: Immediate actions for the next 90 days
For companies that have not yet aligned systems and procedures, prioritize:
- Audit current IT stack for eFTI/eCMR compatibility and vendor roadmaps.
- Verify all driver tachographs are up to date and that downloads are automated.
- Confirm EORI and VAT/IOSS registrations and reconcile recent entries for accuracy.
- Establish SLA with a customs broker experienced in PL/NL/BE cross-border flows.
Cost, penalty exposure and operational impact
Non-compliance can result in fines, shipment delays, and reputational damage with major shippers. The most common cost drivers are administrative penalties for missing ENS filings, suspension of cabotage privileges after repeated violations, and detention fees at ports when documentation is incomplete.
Fact: According to Eurostat, road transport accounts for roughly 75% of inland freight tonne-kilometres in the EU, underscoring why digital and procedural alignment between member states is critical for uninterrupted trade flows.
