Overview of Recent DHS I-9 Audits in California’s Trucking Sector
The Department of Homeland Security (DHS) has launched a comprehensive campaign to audit the employment eligibility of truck drivers across California, focusing heavily on verification via I-9 forms. This initiative targets trucking companies throughout the state, particularly those operating in the Northern California region.
Historical Context: Evolution of Employment Audits in Trucking
Over the past two decades, employment verification and compliance audits have increasingly influenced the trucking industry. Initially, enforcement centered on documentation accuracy primarily for large corporations, but growing concerns about labor law compliance have expanded audits to target smaller operators as well. In California, the trucking community has undergone significant scrutiny, aligned with stricter federal immigration regulations and workforce eligibility requirements.
The Punjabi Trucking Community's Role and Size in California
California hosts a substantial segment of the Punjabi and Sikh trucking community, with estimates ranging from approximately 50,000 to 74,000 drivers and owner-operators. This group represents around 40% of the state's long-haul trucking workforce. Nationally, Punjabi/Sikh trucking professionals make up 150,000 to 200,000 drivers, controlling an estimated 20% of U.S. trucking companies despite being a small proportion of the total driver pool.
North American Punjabi Trucking Association (NAPTA) lists over 1,400 member firms with more than 9,000 trucks, a partial representation of the broader community.
Many smaller Punjabi carriers continue to operate under the 1099 independent contractor model, maintaining competitive costs but facing exposure to labor law claims and federal audits.
Current Developments and Impact on Freight Carriers
Since June, a reinstated English proficiency requirement for Commercial Driver’s License (CDL) holders has resulted in over 7,000 drivers being removed from active service. Additionally, Immigration and Customs Enforcement (ICE) workplace enforcement in California surged sharply in 2025; more than 77 trucking companies in Northern California have been affected within the first half of the year alone.
This regulatory climate is forcing freight carriers to reexamine their labor structures, compliance procedures, and risk management strategies. Smaller carriers utilizing independent contractors under Agile Contractor frameworks are increasingly vulnerable to audits and penalties, which may lead to operational slowdowns and reduced driver availability, ultimately impacting delivery schedules and revenue streams.
Table: Effects of Enforcement Measures on California Truck Fleets (2025)
| Metric | Value | Implications for Carriers |
|---|---|---|
| Drivers Removed Due to English Proficiency | 7,248 | Reduced driver availability, potential increase in hiring costs |
| ICE Audits on Trucking Firms (Northern California) | 77 companies audited in H1 2025 | Higher compliance costs, risk of legal exposure |
| Estimated Punjabi Truck Drivers in California | 50,000–74,000 | Significant workforce segment under scrutiny |
Statistical Insights
The Punjabi/Sikh community’s substantial presence in the California trucking sector highlights how localized demographic groups can influence regional freight logistics. Despite representing only about 4-5% of the national driver workforce, they control up to 20% of trucking companies in the U.S., showcasing their significant market share and influence.
